1. What Chosen Years Is, and What It Is Not

Chosen Years is a national directory and editorial resource covering LGBTQIA+-affirming senior living, care providers, community organizations and aging professionals. It exists to help you find organizations, compare them, and see what has and has not been documented about each one.

We are not a senior living provider, a care agency, a broker, a referral service or a placement service. We do not deliver care, we do not arrange it, and we do not recommend a particular provider to a particular person.

We take no referral fee, no commission and no payment from any provider in connection with anyone who contacts them through this Site. Providers can buy a listing plan, which is disclosed on our pricing page and labeled where it appears. That is the only money that moves. This matters because much of the senior living search industry is paid on placement, and a directory that took a commission could not honestly tell you which questions to ask.

2. Not Professional Advice, and Not an Emergency Service

Everything on the Site is general information. It is not medical, legal, financial or care advice, it is not a substitute for professional judgment, and reading it creates no professional relationship of any kind. Decisions about where somebody lives, what care they receive and how it is paid for should be taken with qualified professionals who know the situation.

If someone is in immediate danger, call 911. To report suspected abuse or neglect of an older adult, contact Adult Protective Services or your state's long-term care ombudsman. Nothing you send us is monitored in real time and we cannot act on an emergency.

3. Listings, Evidence Labels and the Limits of Both

Where listing information comes from

Most listings were built by us from public sources: an organization's own website, published credential registers and government records. Some were submitted or corrected by the organization. Either way, information changes and mistakes happen. Confirm anything that matters, including licensing, availability, pricing and current policies, directly with the provider before you rely on it.

What an evidence label means

An evidence label records what was documented, from a stated source, on a stated date. It is a description of a record, not an endorsement, a guarantee or an opinion about the quality or safety of a provider, and it does not promise that anything remains true today. A credential can lapse, an organization can change hands, and staff who were trained can leave. Each label carries its own plain-language statement of what it does and does not prove, and those statements are part of these Terms.

A paid plan never buys a label

Listing plans affect how a listing looks and where it appears. They never buy, influence, upgrade or alter an evidence label, and no provider can award itself one. Paid and sponsored placement is always labeled as such. If you ever find otherwise, tell us and we will treat it as a serious error.

An absence is not an accusation

Where we say something is not on file for a provider, that means we have not seen it, not that it does not exist. Small and volunteer-run organizations tend to have the fewest published records and are often among the most affirming places in their area. Please read our blanks that way, and ask.

4. Government Inspection and Licensing Records

Some listings show records published by government regulators, including Medicare inspection ratings, inspection findings, citations, staffing figures and financial penalties, together with links to state licensing registers.

That material comes from the public record and is reproduced as the regulator published it, with the date of the release it came from. It is a snapshot. Regulators update on their own schedules, findings are often disputed or corrected, and a provider may have fixed a problem since. We do not add our own conclusions to it, we do not net serious findings off against good ratings, and we do not fold any of it into a score of our own.

Inspection records measure regulatory compliance. They do not measure whether a provider will treat an LGBTQIA+ resident and their partner with respect, and a well-rated provider can still get that badly wrong.

If you are a provider and you believe a record has been matched to the wrong organization, tell us immediately and we will remove it while we check. Attaching one organization's record to another is the most serious error we could make, and we would rather show nothing than show that.

5. If You Manage a Listing

What you are promising us

By submitting or claiming a listing you represent that:

• You are authorized to act for the organization
• What you tell us is accurate and not misleading, including about policies, credentials and affiliations
• You own or have permission to use every photograph and document you upload, and their use here will not infringe anyone's rights
• You will keep the listing current, and will tell us when something we publish stops being true

What we may do

We review submissions and claims before they publish. We may decline, edit for accuracy or house style, ask for evidence, or unpublish a listing. A claim does not transfer ownership of the listing, and paying for a plan never establishes control over a listing that has not been verified as yours.

Removing your listing

You may ask us to correct or remove your organization's listing at any time and we will act on it. We will not ask you to prove a legal ground first, we will not make it conditional on buying anything, and we will not require you to speak to a salesperson.

6. Paid Plans, Renewal and Refunds

Automatic renewal

Paid listing plans are subscriptions. Unless you cancel, they renew automatically at the end of each billing period, monthly or annually as chosen at checkout, and the payment method on file is charged at the then-current rate for that plan. Prices, billing period and renewal are shown before you pay.

Cancelling

You can cancel at any time from your dashboard or by emailing hello@chosenyears.com. Cancellation takes effect at the end of the period already paid for. The listing then reverts to a free listing rather than disappearing, so nothing you built is lost and nobody searching for the organization stops finding it.

Refunds

If you pay for a plan when submitting or claiming a listing and we do not approve it, we refund the payment in full and cancel the subscription. Beyond that we do not refund part-used periods, except where the law requires it or where we have made a mistake, in which case we will put it right.

Changes to plans

We may change plan features or prices. A price change applies from your next renewal, never retroactively, and we will tell you before it takes effect so you can cancel first.

7. Answers, Corrections and Other Things You Send Us

Each listing carries a checklist of questions and a way to send back what a provider told you. Nothing sent through it is published automatically. Everything is read by a person first.

How an answer can be used depends on who sent it. An answer from staff is the organization's own account of itself and may be published as such, with a date. An answer from a resident, a family member or somebody weighing a provider up is one person's experience: we take it seriously, it tells us where to go and ask, and it is never published as a fact about the provider.

Please do not send us information about other people. Do not name individual members of staff, and do not describe another person's health or care. If you do, we will remove it.

When you send us content of any kind, you grant us a non-exclusive, worldwide, royalty-free licence to store it, review it and, where these Terms allow, publish it as part of the Site. You keep ownership of it, and you confirm you have the right to send it.

8. Acceptable Use

You agree not to:

• Submit false, misleading or fraudulent information, or impersonate an organization or a person
• Harvest, scrape or copy the directory at scale, by any automated means, except as our robots file permits
• Use anything on the Site to generate sales leads, to build a competing directory, or to train a machine-learning model
• Contact providers or people listed here for marketing purposes
• Harass, threaten or defame any organization or individual
• Upload malicious code, or attempt to disrupt the Site or gain access to any part of it you are not entitled to
• Use the Site for any unlawful or discriminatory purpose

We may remove content, unpublish a listing, and suspend or end access for conduct that breaches these Terms.

9. Intellectual Property and Copyright Complaints

Our editorial writing, evidence framework, design, name and logo belong to us or our licensors. You may link to us freely and quote us with attribution. You may not reproduce the directory or substantial parts of our editorial content without written permission.

Some listings show photographs taken from the organization's own public website, used to illustrate that organization's entry. We remove any image on request from the organization or the rights holder, without argument and without asking for anything in return.

If you believe material on the Site infringes your copyright, email hello@chosenyears.com identifying the work, the exact page, your contact details, and a statement that you believe in good faith the use is not authorized and that your notice is accurate. We will remove or disable the material while we look into it.

10. Other Websites and Other People's Services

The Site links to provider websites, government registers and other resources, and it can put you in touch with a provider. We do not control any of them and are not responsible for their content, their practices, or the care or services they provide. Anything that happens between you and a provider is between you and that provider.

11. Disclaimer of Warranties

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error free, or that any listing, evidence label, inspection record or other information is accurate, complete or current.

12. Limitation of Liability

To the fullest extent the law allows, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Site, your reliance on a listing or an evidence label, or your dealings with any provider. Our total liability for any claim relating to the Site will not exceed the greater of one hundred United States dollars or the amount you paid us in the twelve months before the claim arose.

Nothing here limits liability that cannot be limited by law, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from claims, losses, liabilities and reasonable legal costs arising out of your use of the Site, the content you submit, or your breach of these Terms, of the law, or of anyone's rights.

14. Suspension and Ending Access

You can stop using the Site at any time and can ask us to close your account. We may suspend or end access if these Terms are breached, or if we need to for legal or security reasons. Sections that by their nature should survive, including the disclaimers, the limitation of liability, indemnification and governing law, continue to apply afterwards.

15. Changes to the Site or These Terms

We may change or discontinue the Site, and we may update these Terms. When we do, we will revise the "Last updated" date above, and where a change materially affects your rights we will give notice on the Site before it takes effect. Continuing to use the Site after that means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and you and we agree that any dispute will be brought in the state or federal courts located in Florida. If you are a consumer, this does not deprive you of the protection of any mandatory law of the place where you live, and it does not prevent either of us from bringing a claim in small claims court.

Before filing anything, please write to hello@chosenyears.com and describe the problem. Most things are faster to fix than to litigate, and we would rather fix them.

17. General

If any part of these Terms is held unenforceable, the rest continues to apply. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of the business. These Terms, together with the Privacy Policy and our published disclosures, are the entire agreement between us about the Site.
